Arsenic Pollution from Dominion Coal Plant Did Not Violate Clean Water Act, Appeals Court Rules

A federal appeals court has ruled that Dominion Energy did not violate the Clean Water Act when arsenic from a coal ash disposal site leached through groundwater into rivers in Virginia. The decision, which reverses a lower court ruling, does not affect the lower court’s finding that arsenic is leaking, but does deal with the regulatory effects of that leakage.
