In an unusual and contentious decision yesterday, the Federal Energy Regulatory Commission affirmed that PennEast Pipeline Co. LLC could seize state-owned land to construct a natural gas project stretching from Pennsylvania to New Jersey. The decision contradicts a previous ruling by a federal appeals court that could land the case in the U.S. Supreme Court as soon as this year.
